The Three Stages of Tenant Eviction

Stage 1 — Serving the Correct Notice

• Use the correct notice type — Section 21 (no-fault) or Section 8 (breach)
• State the correct dates — any arithmetic error can invalidate the notice
• The tenant's deposit must be protected in an approved scheme before service
• Prove service — use recorded delivery or personal delivery with a witness

Stage 2 — Applying for a Possession Order

• Apply to the County Court online using MCOL for Section 21, or Form N5 for Section 8
• A court hearing is typically listed 2–3 months from application
• Critical tip: Request permission to transfer to the High Court when applying — this one step saves significant time and money at Stage 3

Stage 3 — Enforcement

• County Court Bailiff — 6–10 weeks to arrange an eviction date. Cheaper but slower.
• High Court Enforcement Officer (HCEO) — 1–3 weeks. Faster and more effective if you transferred the case at Stage 2.
